You'd think that Project Runway judge Michael Kors, who often lambasts contestants for a lack of originality or for being too inspired by someone else's work, would live by this standard when it comes to his own designs. I guess not.
The new Kors 'Hamilton' bag (right) is so obviously "too inspired" by the classic Hermes 'Birkin' bag (left), but I'm sure the Kors corporate legal team made sure that their knock-off is just different enough to avoid a lawsuit. Shame on you, Mr. Kors.
My understanding is you can patent a logo, but not a design (yet). So Kors could make an identically looking bag but as long as he didn't slap "Hermes" on it, he'd be in the clear....
ReplyDeleteIts a little more complicated than that, Anonymous. There have to be "points of difference" to get past the legal department, but I think the intent here is clear.
